If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy and website disclaimer (Limitation of Liability & Warranties) govern our relationship with you in relation to you and your use of this website.
Amendment of Terms
We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you chose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance of amended terms.
Delivery of Goods
Free delivery is available for any orders of 6 bottles or more that have an address which resides within a 30km radius from our cellar door.
Physical goods may be delivered by Australia Post and/or other reputable courier companies. Upon confirmation deliveries are processed promptly upon receipt of full payment, however may be delayed at our discretion if weather conditions are not favourable for our wines to travel (i.e. over 35 degrees celsius). We will contact you in this instance.
Damaged or lost orders should be resolved with Australia Post or the courier company directly, and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made if the insurance option is selected during the online checkout process.
Governing Law
This website is controlled by Capogreco Wines Pty Ltd from our office located in the state of Victoria, Australia. Therefore this agreement and this website are governed by the laws of Victoria, Australia.
International Purchases
We are unable to deliver outside Australia. If you are seeking to purchase from outside Australia, please contact us and we will endeavour to assist you.
Limitation of Liability & Warranties
It is an essential pre-condition to you using our website that you agree and accept that Capogreco Wines Pty Ltd is not legally responsible for any loss or damage you might suffer in relation to your use of the website.
It shall be your own responsibility to ensure that any goods, services or information available through this website meet your specific personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Subject to the above, we are not liable to you (or to any third party claiming through you) for, and you release us from any loss, liability, damage, expense or cost whatsoever and includes (without limitation) indirect or consequential loss or damage of profits or business opportunity, and damage to equipment or property caused by any act or omission of Capogreco Wines Pty Ltd, its employees or agents, and whether based on negligence of other tort, contract or otherwise.
Minimum Legal Drinking Age
Only persons of legal drinking age in their country of residence may access or view this website. By accessing or viewing this website you warrant that you are of legal drinking age in your country of residence. These terms of use are governed by the laws of the state of Victoria, Australia.
Payment
All prices are quoted in Australian Dollars ($AUD), and include all relevant Australian taxes. You must pay for the goods before we despatch your order through our payment gateway. Credit card details are passed through the secure payment gateway and processed immediately, and are not retained on file.
Price
Our prices are subject to change and variation without notice. The price payable for the goods is the price applicable on the date your order is confirmed. The quoted price does not include delivery and insurance (if applicable) in respect of each order. The total amount payable is the price for each of the goods, together with the applicable delivery and insurance fees.
Privacy
Your privacy is very important to us, which is why we have created a separate Privacy Policy in order to explain in detail how we collect, manage, process, secure, and store your private information. Returns and Refunds
All sales are final, and no returns or refunds are accepted. Any replacements are made at the discretion of Capogreco Wines Pty Ltd.
Risk and Title
Risk and title in the goods passes to you upon delivery of the goods to the nominated delivery address.
Termination of Use
Capogreco Wines Pty Ltd reserves the right to terminate a contract at any time by notice to you. Termination is effective on the day notice is received, or such later date as specified in the notice.
